1. Scope
These Terms of Use govern the relationship between Crewz GmbH (hereinafter “we”) and the users of the Capsy app.
By using the app, you agree to these terms.
2. Description of Services
Capsy is a mobile app that allows you to write personal letters to your future self and open them at a later time.
The basic features of the app are free to use.
In addition, we offer optional paid features (e.g. credits for longer time periods) through in-app purchases.
3. In-App Purchases
a) One-time purchases (Credits)
Digital content (“credits”) can be purchased within the app to unlock additional features.
- Prices are clearly displayed before purchase
- Purchases are one-time payments
- There is no automatic renewal
- Purchased credits do not expire
4. Payment Processing
Payments are processed exclusively through the respective app stores (Apple App Store or Google Play Store).
We do not receive your payment details, only a confirmation of the completed purchase.
5. Right of Withdrawal & Refunds
For digital content that is provided immediately after purchase, the right of withdrawal may expire once the service has been fully delivered.
Refunds are handled solely in accordance with the policies of the respective platform providers (Apple or Google).
6. User Content
You are responsible for the content you create in Capsy (e.g. letters and texts).
You agree not to store or share any unlawful content.
7. User Obligations
You agree:
- not to misuse the app
- not to circumvent technical protection measures
- not to copy or distribute the app or its content without authorization
You are responsible for backing up your own data.
8. Account and Deletion
You can delete your account at any time within the app.
Upon deletion, your stored data, including your letters, will be permanently removed, unless legal retention obligations apply.
9. Changes to the App / Availability
We reserve the right to modify, expand, or discontinue app features at any time, particularly for technical or legal reasons.
There is no entitlement to the permanent availability of specific features.
10. Liability
We are only liable in cases of intent or gross negligence.
We are not liable for data loss, service interruptions, or indirect damages, except in cases of breach of essential contractual obligations.
11. Privacy
The processing of personal data is governed by our Privacy Policy.
12. Applicable Law
The laws of the Federal Republic of Germany apply.
Place of jurisdiction, where legally permissible, is Freiburg im Breisgau.
